APSP-Supported Legislation Narrowly Fails In Texas Legislature
An APSP-supported bill that would add Texas to the growing list of states following the Virginia Graeme Baker Pool & Spa Safety Act and the ANSI/APSP-7 Standard on Suction Entrapment Avoidance recently failed by a one-vote margin in a House committee of the Texas legislature.
The bill, Texas SB 96 relating to swimming pool safety, originally required SVRS or similar devices on all new pools - even pools with unblockable drains - putting it at odds with ANSI/APSP-7 standards and the VGB Act.
APSP worked successfully with the bill's sponsor, Senator Leticia Van de Putte, Senate District 26-San Antonio, to amend the bill to be consistent with the VGB Act and ANSI/APSP-7. However, House committee members had concerns over the barrier language and repair/remodel retrofit requirements contained in the bill.
The 2009 Texas legislative session concluded on June 1 and Texas lawmakers will not meet again for a regular session until the January 2010 legislative session.
APSP will be working with counties and municipalities in Texas for their adoption of the 2009 International Residential Code (IRC), which incorporates ANSI/APSP-7.
